Terms of Use – Empower Simcoe Marketplace

Welcome to the Empower Simcoe Marketplace (“Marketplace”). By accessing, browsing, registering, or making a purchase through this website, you agree to be bound by these Terms of Use. Please read them carefully.

If you do not agree with these Terms, please do not use the Marketplace.

1. About Us

The Empower Simcoe Marketplace is operated by Empower Simcoe, a non-profit organization based in Barrie, Ontario, Canada.

The Marketplace provides access to branded merchandise and registration for Fee For Service programs.

2. Using the Marketplace & Eligibility

You agree to use the Marketplace only for lawful purposes and in a way that does not infringe the rights of others or restrict their use of the site.

You must be at least 18 years old, or have the consent of a parent or legal guardian, to create an account or make a purchase.

We reserve the right to suspend or terminate access to the Marketplace for misuse or violation of these Terms.

3. User Accounts

Some features of the Marketplace require you to create an account.

You are responsible for:

Providing accurate and complete information
Maintaining the confidentiality of your login credentials
All activities that occur under your account

You agree to notify us immediately of any unauthorized use of your account.

4. Privacy

Your personal information is handled in accordance with the Marketplace Privacy Policy:

5. Product Availability & Fulfillment

All merchandise products are made to order using third-party print-on-demand services. Fulfillment times may vary, and product availability is subject to change without notice.

We make reasonable efforts to keep product listings accurate, but we do not guarantee that all products will be available at all times.

6. Pricing, Taxes & Payment

All prices are listed in Canadian dollars (CAD) unless otherwise stated. Payment is due at the time of order.

At this time, applicable taxes may not be charged on all purchases. Empower Simcoe reserves the right to apply applicable taxes (including HST) in the future in accordance with legal requirements.

We accept major credit cards and other secure payment methods listed at checkout.

7. Shipping & Delivery

We aim to fulfill and ship orders promptly. Shipping times may vary depending on the product and third-party fulfillment providers.

Empower Simcoe is not responsible for delays caused by third-party service providers, shipping carriers, or events beyond our reasonable control.

8. Returns & Refunds

Because our products are made to order, we do not accept general returns or exchanges. Refunds are issued only in the case of damaged or incorrect items. See our Return Policy for more information.

9. Program Registrations

Fee For Service programs are subject to availability and may have their own cancellation, withdrawal, and refund policies.

By registering for a program, you agree to the specific terms and policies provided at the time of registration. In the event of a conflict between these Terms and a program-specific policy, the program-specific policy will prevail.

10. Intellectual Property

All content on the Marketplace, including logos, designs, product images, text, and program materials, is the property of Empower Simcoe or its partners and is protected by intellectual property laws.

You may not reproduce, distribute, modify, or use any content without prior written permission.

11. Disclaimer & Limitation of Liability

The Marketplace and all services are provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, Empower Simcoe shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from your use of the Marketplace, products, or program registrations.

12. Force Majeure / Service Interruptions

We are not responsible for delays or failures caused by events beyond our reasonable control, including system outages, supplier delays, shipping disruptions, or acts of nature.

13. Changes to These Terms

We reserve the right to update these Terms of Use at any time. Changes will be posted on this page with an updated “Last Updated” date. Continued use of the Marketplace after changes are posted constitutes acceptance of the revised Terms.

14. Governing Law

These Terms of Use are governed by the laws of the Province of Ontario and the laws of Canada applicable therein. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ontario.
